These General Terms and Conditions of Sale govern sales made through the website, verbally during a phone call or at an event, or via written communication, whether by email or private message on social media.

Terre de Gymnaste reserves the right to modify these terms and conditions at any time by publishing a new version on the website. The applicable Terms and Conditions are those in effect at the time of payment.

1. Ordering/Payment:

• -Prices for designs and customizations are calculated on a project-by-project basis.
• Orders are placed in French or English, and orders are billed in Euros.
• The creation of a computer simulation costs €30 per model and is made exclusively for you. This mockup is not created using software with pre-saved templates.
• The prices listed are subject to change without prior notice.
• Payments are accepted via PayPal, credit card, or bank transfer (exclusively for clubs)
• Orders are processed upon confirmation of payment; the same applies to shipments of in-stock items. For orders of more than 60 leotards, payment in two installments is available: 60% upon ordering, 40% prior to delivery, upon your written request.
• Once an order has been paid for and processed, it cannot be canceled; please be sure to carefully check the proofs and the sizes ordered.
• Offers are valid while supplies last.
• Promotional codes are intended solely for purchases made via the website, they cannot be combined with gift cards or current promotions. 

 

2. Shipping:

• For in-stock items, orders will be processed within 2 to 3 business days. Once the package has been handed over to the carrier, delivery takes 48 hours via Colissimo (mainland France) and a few additional days for other countries. Processing times may be longer depending on the season (end of the year, sales, etc.).
• These delivery times do not include the time required to prepare the package. You will receive an email from the carrier once your package has been picked up.
• For custom-made items and made-to-order items that are not in stock, the delivery time is 8 to 12 weeks, depending on when the order is placed.
• The delivery times provided when placing your custom order are approximate and may vary depending on the time of year. There may be a delay of one to two weeks for custom orders and custom-made items. The buyer is not entitled to any compensation or refund in the event of a delay.
• Terre de Gymnaste assumes no liability for the transportation of the products or any risks associated with them once the buyer has taken possession of them or, failing that, once they have been made available to the buyer. Should the buyer change the delivery or pickup location, any storage of the products will be at the buyer’s own risk and expense.
• You have a 14-day right of withdrawal from the date of payment for items made to your specifications (Article L121-21-8 of the French Consumer Code).

3. Returns:

• Before returning any item, please notify us by email at the following address: contact@terredegymnaste.com, with the subject line: ‘Return’. Please also include your order number.
• No returns will be processed without prior notice and approval from us.
• Terre De Gymnaste does not offer exchanges.
• In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the order to exercise their right of withdrawal with Terre De Gymnaste. Beyond this period, the sale is final and binding.
• The returned item must be sent back in its original packaging, with the label and hygiene stickers intact. Otherwise, the request for an exchange or refund will be refused.
• You have 72 hours to ship your item once your request has been approved.
• The return must be shipped via tracked shipping and include the return form (downloadable at the bottom of the page). Terre de Gymnaste reserves the right not to process the request if these conditions are not met.
• Any defects found in your order must be reported by email within 48 hours of the delivery date. After this period, Terre de Gymnaste disclaims all liability and reserves the right not to process the request.
• Returned items that are damaged, worn, or missing their tags or hygiene stickers will not be accepted. You will be charged for return shipping costs, and the package will be returned to you after payment is confirmed.
• In the event of a delivery error on the part of Terre De Gymnaste (e.g., wrong size, wrong color), return shipping costs will be covered, and you may choose between a refund or an exchange*.
• If the return is due to an error on your part (choice of size/color), an exchange is possible only if the garment is UNUSED, in new condition, and meets the conditions above. In this case, you are responsible for the return and reshipping costs.
• No returns due to improper care will be accepted; please be sure to read the leotard care instructions (link at the bottom of the page)
• In the event that a package is not picked up or is lost during a return, Terre de Gymnaste cannot be held responsible for incidents occurring during transit. No refund or compensation may be claimed in the event of loss or misplacement attributable to the delivery provider.

Terre de Gymnaste reserves the right to refuse refunds for products returned by the customer if it determines or suspects a violation of the return policy, or if the customer exhibits an unusual, excessive, or abusive pattern of returns (for example, a customer who wears or damages the clothing before returning the item, or who systematically or excessively returns all or part of their orders)

In the event of an unapproved return, return shipping fees will be charged to the customer. The item will only be shipped back after the shipping fees have been paid.

Terre De Gymnaste accepts no liability for the loss of packages returned by the customer. No refund or compensation will be provided if the item is returned without tracking.

NOTE: Custom-designed and personalized outfits are NEITHER EXCHANGEABLE NOR REFUNDABLE—they are made specifically for you! Please be sure to choose the correct size and color.

4. Warranty:

• All outfits are inspected before shipment; however, the buyer must inspect the items upon receipt.
• Any defects found must be reported by email to terredegymnaste@gmail.com within 72 hours of receiving your order
• In the event of exceptional circumstances affecting the order, such as unforeseen interruptions in production or delivery, strikes, embargoes, fabric shortages, etc., Terre de Gymnaste will suspend fulfillment of the order. Every effort will be made to mitigate any difficulties encountered.
